The law says Palestinians. It does not say adults only.
Israel's military courts set the minimum age of criminal responsibility at 12 years old. Palestinian children as young as 12 are already being tried in these courts. The death penalty law applies to those courts. There is no age exemption written into the legislation.
As of December 31 2025, 351 Palestinian children were detained in Israeli prisons. Of those, 51 percent were held under administrative detention: imprisonment without charge, without trial, renewable every six months, indefinitely. Defence for Children International-Palestine described both the number and the proportion as records.
The law mandates execution by hanging within 90 days of sentencing. No clemency. No real appeal. Family members can be excluded from the execution. The law grants immunity to those who carry it out.

94 percent of children were interrogated without a parent present.
Palestinian children in the West Bank are tried exclusively in Israeli military courts. These courts convict 96 percent of Palestinian defendants according to B'Tselem. Convictions are based largely on confessions obtained under duress and torture during interrogations.
Defence for Children International-Palestine documented that 94 percent of detained Palestinian children were interrogated without a family member present. 89 percent were not told the reason for their arrest. Many signed confessions in Hebrew, a language they cannot read.
In March 2025, 17-year-old Walid Ahmad died inside Megiddo prison. His autopsy revealed extreme muscle wasting, dehydration, untreated infections and scabies. He is the first documented death of a Palestinian child in Israeli detention. Defence for Children International-Palestine, 2025.

What counts as terrorism under this law.

Stone-throwing carries a maximum sentence of 20 years under military law.
The death penalty law applies to killings designated as terrorist acts under Israel's counter-terrorism legislation. That framework is so broad that children have faced terrorism charges for acts committed during protests. UN Special Procedures documented this in 2025.
Stone-throwing is the most common charge against Palestinian children. Under Israeli military law it carries a maximum sentence of 20 years. The same legal framework that governs stone-throwing charges now governs the death penalty. Same courts. Same conviction rate. Same confessions in Hebrew.
Save the Children stated that Palestinian children are the only children in the world systematically tried in military courts. That statement was published in 2023. This law was passed into that system in 2026.

International law explicitly prohibits executing children. This law does it anyway.
Israel ratified the Convention on the Rights of the Child on October 3 1991. That treaty prohibits capital punishment for offences committed by persons below 18. The Fourth Geneva Convention prohibits cruel, inhuman or degrading treatment of protected persons including children. Israel is still legally bound by both.
On February 5 2025 Israeli Foreign Minister Gideon Sa'ar announced Israel would no longer participate in the UN Human Rights Council. The UNHRC spokesperson confirmed Israel only held observer status and could not formally withdraw. Israel remains a party to its human rights treaty obligations regardless. The CRC is a separate treaty. Withdrawing from the Council does not remove the obligation.
The Gallows Law was passed inside a system the ICJ found in July 2024 violates the prohibition of racial segregation and apartheid. The UN OHCHR stated on April 1 2026 the law institutionalises arbitrary and discriminatory deprivation of life. Israel passed it anyway.

A law that can hang a 12-year-old. In courts that convict 96 percent of the time.
The Convention on the Rights of the Child prohibits it. The Fourth Geneva Convention prohibits it. The ICJ found the system it operates within violates the prohibition of apartheid. The UN called it a possible war crime. The Knesset's own legal adviser said it was unconstitutional. It passed anyway. 62 to 48. The documented record is not in dispute. The absence of a response from most governments is also part of the record.
