Breaking Brief - Israel's Death Penalty Law
BREAKING BRIEF · MARCH 30 2026
Israel passed a death penalty law. It only applies to one people.
The Knesset voted 62 to 48. The law takes effect in 30 days. The UN called it a possible war crime. This is not a proposal. This happened last week.
What the law says
02 / 08
Death by hanging. Within 90 days of sentencing. No clemency. No real appeal.
Military courts in the occupied West Bank must impose the death penalty as the default for Palestinians convicted of fatal attacks. Judges can substitute life imprisonment only under vaguely defined special circumstances.
Execution within 90 days of the final ruling. The law grants immunity to those who carry out executions. Family members can be excluded. External oversight is severely restricted.
In civilian courts inside Israel, the death penalty applies only to those who killed with the aim of negating the existence of the State of Israel. That ideological clause is designed to exclude Jewish defendants. It applies to Palestinians alone.

Same land. Same act. Different law.
03 / 08
Palestinian kills an Israeli. Israeli kills a Palestinian.
Palestinian · Military Court
Mandatory death by hanging. Conviction rate 96 to 99 percent. Confessions often obtained under torture. 90-day execution deadline. No clemency. Senior Israel Democracy Institute fellow confirmed on record: "Jews will not be indicted under this law."
Israeli · Civilian Court
Not covered by this law. Jewish settlers who kill Palestinians are tried in civilian courts under separate legal standards. The ideological clause in the civilian provision excludes them by design. Full due process rights apply.

The courts that will apply this law
04 / 08
Military courts convict Palestinians 96 to 99 percent of the time.
Palestinians in the West Bank are tried exclusively in Israeli military courts. Israeli settlers living on the same land are tried in civilian courts with full due process. The same act. Two systems.
Under this law, military judges can impose death by simple majority. Before this law, a death sentence required a unanimous panel. That threshold was never met in any terrorism case in Israeli history.
B'Tselem stated that in many cases convictions are based on confessions obtained through pressure and torture during interrogations. This law allows execution to proceed without designated officials or any family member present.

The vote. The celebration. The man who led it.
05 / 08
Ben-Gvir wore a noose pin. Netanyahu voted yes in person.
The law was championed by National Security Minister Itamar Ben-Gvir of the far-right Otzma Yehudit party. He and party members wore noose-shaped lapel pins during Knesset sessions. When the law passed he was photographed celebrating with champagne.
Prime Minister Benjamin Netanyahu attended the chamber personally to vote in favour. Netanyahu is currently subject to an International Criminal Court arrest warrant for war crimes and crimes against humanity.
The law was opposed by senior Shin Bet officials, the Israel Defense Forces, and the Israeli Medical Association. The Knesset's own legal adviser said during deliberations it was discriminatory and unconstitutional. It passed anyway.

Named bodies. Named statements. All on record.
06 / 08
Every major rights body condemned it.
UN Human Rights Chief Volker Turk said the law constitutes a discriminatory regime of capital punishment and may amount to a war crime. The UN OHCHR stated it institutionalises arbitrary and discriminatory deprivation of life.
Human Rights Watch called the wording discriminatory by design and said it will primarily, if not exclusively, be applied to Palestinians. Amnesty International called for immediate repeal.
The International Court of Justice had already ruled in July 2024 that Israel's legal measures in the occupied Palestinian territory violate the prohibition of racial segregation and apartheid. This law was passed inside that system.

We are not making a claim. We are asking a question.
07 / 08
One law for one ethnicity. Courts that convict 99 percent of the time. Confessions under torture. Execution in 90 days.
What do you call a system like this? The Knesset's own legal adviser said it was discriminatory and unconstitutional. It passed. The UN called it a possible war crime. It passed. The ICJ found the system it operates within violates the prohibition of apartheid. It passed. Your government has not cut ties with the state that passed it.
Some stories are buried on purpose. We dig.
